Maintenance Execution Procedure
Maintenance Execution Procedure explained step by step for maintenance matters in Pakistan.
Court Ordered Maintenance But Still Not Getting Paid? Here's What Happens Next
Winning a maintenance case feels like the end of the battle.
For many families, it is only the beginning.
Every month we meet women who tell us:
"The Family Court ordered maintenance six months ago, but I have not received a single rupee."
Others arrive carrying court judgments and ask:
"If the court already decided the case, why is nobody forcing him to pay?"
The answer usually lies in a separate legal process known as execution proceedings.
A maintenance order is a court decision. Execution is the process used to turn that decision into actual recovery.
At Malhi Law Associates, many maintenance clients return after winning their cases because the husband simply ignores the order. This is where maintenance execution proceedings become important.
The Most Common Misunderstanding About Maintenance Cases
Many people believe:
"Once the judge passes an order, the money automatically starts coming."
Unfortunately, that is not always what happens.
Some respondents pay immediately.
Others delay payments, make excuses, disappear, change jobs, transfer assets, or simply refuse to comply.
That is when enforcement becomes necessary.
How Do You Know It's Time To Start Execution Proceedings?
Execution usually becomes necessary when:
Maintenance was ordered but nothing has been paid.
Payments started and later stopped.
Only partial amounts are being paid.
Large arrears have accumulated.
The respondent is deliberately avoiding compliance.
Many clients wait years hoping the situation will improve voluntarily.
In reality, delay often makes recovery harder.
Before Filing Anything, Calculate What Is Actually Owed
One of the first things a lawyer will usually ask is:
"How much maintenance remains unpaid?"
Surprisingly, many people do not know.
Prepare a record showing:
Monthly amount ordered by the court.
Date of judgment.
Payments received.
Payments missed.
Total arrears outstanding.
Good records often make execution proceedings significantly easier.
What If He Says He Cannot Afford To Pay?
This is one of the most common responses after a maintenance order is passed.
"I lost my job."
"My business is not doing well."
"I am living abroad now."
Whether these explanations affect enforcement depends on the facts, evidence, and circumstances of the case.
Simply refusing to pay is not the same as proving an inability to pay.
Execution Starts With The Existing Judgment
Unlike a new maintenance case, execution proceedings begin with a judgment that already exists.
The court has already decided:
Maintenance is payable.
Who must pay.
How much must be paid.
The focus now shifts from proving entitlement to enforcing compliance.
Documents Usually Needed For Maintenance Execution
Family Court judgment.
Decree or final order.
Record of payments received.
Calculation of arrears.
Identity documents.
Relevant court documents.
What If The Husband Is Working Abroad?
Many maintenance defaulters live in:
Saudi Arabia.
UAE.
Qatar.
United Kingdom.
Canada.
Europe.
One of the most common questions is:
"He earns in Dubai but refuses to send money to his children in Pakistan. Can execution still be filed?"
Overseas residence does not automatically eliminate maintenance obligations.
Many such cases arise after proceedings under the Overseas Maintenance Procedure.
Can Maintenance Arrears Be Recovered Years Later?
Another frequent question is:
"My husband stopped paying three years ago. Is it too late?"
The answer depends on the facts, court orders, payment history, and procedural circumstances.
A legal review should be conducted before reaching any conclusion.
Don't Ignore Small Missed Payments
Many maintenance problems begin with a single missed payment.
Then:
One month becomes six months.
Six months becomes a year.
A year becomes several years of arrears.
The earlier enforcement action is considered, the easier it often becomes to establish the payment history.
