How Child Maintenance Is Calculated in Pakistan

One of the most common questions asked in Family Courts across Pakistan is:

How much child maintenance will the Court order?

Many parents expect there to be a fixed formula.

They assume there is a government chart that automatically determines maintenance based on the child's age.

Others believe maintenance is calculated as a fixed percentage of the father's income.

In reality, Family Courts examine the specific circumstances of each case before determining an appropriate amount of child maintenance.

This is why two different cases can result in two very different maintenance orders.

There Is No Fixed Monthly Maintenance Amount In Pakistan

One of the biggest misconceptions is that Pakistani law provides a fixed maintenance amount for all children.

It does not.

Family Courts generally consider:

  • The needs of the child.

  • The financial capacity of the father.

  • The family's standard of living.

  • The child's education expenses.

The Court's goal is not simply to pick a random number.

What does the child reasonably require every month?

A better question is:

What are the child's actual needs and what is the father's actual ability to contribute?
